Terms of Service

Effective date: April 21, 2026

These Terms of Service (“Terms”) are a contract between you and Dream Engine Inc. (“Cigarro,” “we,” or “us”), Alberta, Canada. They govern your use of the Cigarro mobile app and web app at app.cigarroapp.com (the “Service”).

By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you don’t agree, don’t use the Service.

1. Who can use the Service

  • You must be at least 18 years old. Cigar products are age-restricted and content on the Service relates to tobacco use. You confirm you meet this age every time you use the Service.
  • You must be legally permitted to receive services from US-based providers (our infrastructure is US-based).
  • You must not be on any US embargo or sanctions list, or located in a jurisdiction subject to comprehensive US sanctions.
  • The Service is not available where prohibited by law.

If you create an account and any of the above becomes untrue, stop using the Service and delete your account.

2. Your account

  • We authenticate you by emailing a one-time passcode (“OTP”) to the address you provide. You are responsible for keeping that email account secure.
  • You are responsible for all activity under your account. Don’t share OTP codes, don’t let anyone else use your account, and notify us immediately at info@cigarroapp.com if you believe your account is compromised.
  • One account per person.
  • You may delete your account at any time from the Profile → Delete account screen. Deletion is immediate and permanent.

3. Subscriptions and payment

Cigarro offers a free tier and paid subscription tiers (“Plans”). The current Plans, prices, and limits are shown in the app on the Profile screen.

  • Free tier: usage is capped (see in-app limits). No payment required.
  • Paid tiers: billed in advance through Stripe on a monthly basis. By subscribing, you authorize us (via Stripe) to charge your payment method for each billing period until you cancel.
  • Automatic renewal: paid subscriptions auto-renew at the end of each billing period unless you cancel before the period ends.
  • Cancellation: cancel any time from Profile → Manage Billing, which opens the Stripe-hosted billing portal. Your paid features remain active through the end of the billing period you already paid for; you will not be charged for the next period.
  • Refunds: no refunds are issued for partial billing periods.
  • Price changes: we may change subscription prices. We’ll give you at least 30 days notice by email before any price change takes effect; the new price applies to your next renewal. You can cancel before then to avoid the new price.
  • Taxes: prices shown do not include taxes. Applicable taxes (sales tax, VAT, GST) will be added at checkout where required.

If your payment fails, we may suspend access to paid features until payment succeeds.

4. Your content

Content you create (humidor entries, reviews, flavor tags, written notes, favorite stores, profile name) remains yours. You own it.

License you grant us: to run the Service, you grant us a worldwide, non-exclusive, royalty-free license to store, display, and transmit your content to you (and, for community reviews you publish to the shared community view, to other Cigarro users in aggregated form). This license lasts only as long as your content is in the Service. When you delete content or your account, the license ends and we delete your content (subject to the retention schedule in our Privacy Policy).

Community reviews: the Service includes an aggregated “community” view for each cigar, built from all users’ reviews. By creating a review, you consent to its ratings and flavor tags being aggregated into this view. Your written notes are not shared. Only the structured signals (ratings, thirds data, flavor tags) are aggregated.

Our intellectual property: the Cigarro app, brand, logo, written copy, UI designs, and the shared cigar catalog structure are the intellectual property of Dream Engine Inc. You may not copy, reverse-engineer, or resell the Service.

5. Acceptable use

You agree not to:

  • Use the Service to violate any law, including tobacco laws in your jurisdiction.
  • Misrepresent your age.
  • Use the Service to sell, solicit, or advertise tobacco products to anyone under the legal minimum purchase age in their location.
  • Upload content that is illegal, abusive, harassing, defamatory, obscene, or infringes anyone else’s rights.
  • Impersonate another person or account.
  • Automate, scrape, or reverse-engineer the Service beyond what a normal user interface allows. API access is not public.
  • Interfere with or overload our infrastructure, or attempt to access data that isn’t yours.
  • Circumvent our plan limits, rate limits, paywall, or other enforcement.
  • Use the Service to spam, send unsolicited messages, or mine personal information about other users.
  • Share access to your paid subscription with others not in your immediate household.

We may remove content, suspend accounts, or terminate service for violations, often without prior notice, though we’ll try to give notice and a chance to cure where reasonable.

6. Health and safety disclaimers

Cigarro is a cigar tracking and journaling tool. It is not medical, health, or legal advice.

  • Cigars contain tobacco. Use of tobacco products is harmful to your health and may cause serious illness, including cancer, heart disease, and addiction.
  • We do not sell, distribute, or recommend cigars. Cigarro only helps you track and review what you choose to smoke on your own.
  • Local laws regarding tobacco purchase, possession, and use vary. You are solely responsible for complying with the laws of your jurisdiction.
  • Ratings, reviews, and community stats shown in the Service reflect users’ personal opinions only. They are not endorsements by us and are not guarantees of quality or safety.

7. Third-party services

The Service integrates with third-party services (Stripe, Supabase, Vercel, Sentry, the RSS news publishers we aggregate). Your use of those services may also be subject to their own terms and privacy policies. We don’t control third-party services and aren’t responsible for their content, availability, or data practices beyond what our Privacy Policy describes.

News articles and links in the Service are provided by independent publishers. Their content is their own, not ours.

8. Warranties and disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory. To the maximum extent permitted by law, we disclaim all warranties including merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, uptime, and any warranty that the Service will be uninterrupted, error-free, or secure.

Some jurisdictions don’t allow exclusion of certain warranties; in those jurisdictions only, the above disclaimers apply to the maximum extent permitted by law.

9. Limitation of liability

To the maximum extent permitted by law, Dream Engine Inc. and its officers, employees, agents, and affiliates will not be liable for:

  • Indirect, incidental, special, consequential, exemplary, or punitive damages;
  • Loss of profits, revenue, data, goodwill, or substitute services;
  • Any claim related to your health, medical outcomes, or the use of any tobacco or related product;
  • Damages arising from third-party content, third-party services, or any conduct of other users.

Our total aggregate liability to you for any claims arising out of or relating to the Service or these Terms is limited to the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) US $50.

Some jurisdictions don’t allow the exclusion or limitation of certain damages; in those jurisdictions, our liability is limited to the maximum extent permitted by law.

10. Indemnification

You agree to defend and indemnify Dream Engine Inc. against any claim, demand, damages, or expenses (including reasonable legal fees) arising from (a) your breach of these Terms, (b) your violation of any law, (c) your content, or (d) your use of the Service in any unauthorized way.

11. Termination

  • You may terminate at any time by deleting your account in the app. Your paid subscription will continue through the end of the current billing period unless canceled separately via the Stripe portal.
  • We may terminate or suspend your account, with or without notice, if you violate these Terms, if we are required to by law, or if we discontinue the Service.
  • Sections that by their nature should survive termination will survive, including ownership, disclaimers, limitation of liability, indemnification, and governing law.

12. Governing law and disputes

These Terms are governed by the laws of the Province of Alberta, Canada, without regard to conflict-of-law principles.

Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the courts located in the Province of Alberta, Canada, and you consent to the personal jurisdiction of those courts. If you are a consumer, this choice of forum does not deprive you of any mandatory rights under the law of your country of residence.

13. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we’ll notify registered users by email at least 30 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the new Terms. If you don’t agree, stop using the Service and delete your account before the effective date.

14. Miscellaneous

  • Entire agreement: these Terms plus the Privacy Policy are the entire agreement between us regarding the Service. They supersede any prior agreements or understandings.
  • No waiver: our failure to enforce any right isn’t a waiver of that right.
  • Severability: if any part of these Terms is found unenforceable, the rest remain in effect.
  • Assignment: you may not assign these Terms. We may assign them to an affiliate or to a successor in an acquisition, merger, or sale.
  • No third-party beneficiaries: these Terms don’t create rights for anyone who isn’t a party.
  • Notices: legal notices to us go to info@cigarroapp.com. Notices to you go to the email address on your account.
